Terms and conditions of use
This is a legal agreement ('the Agreement') between all users and Universityyaar. By accessing the Universityyaar.com website (the 'Service'), you agree to be bound by the Terms and Conditions of this Agreement whether as standard or full member, and your acceptance of this agreement is reaffirmed each time you access the service.
Provision of Service
The Company provides the Service with no warranties of any kind, expressed or implied by statute, common usage or otherwise. Use of this service is at your own risk, at all times. In particular, the Company disclaims any implied warranties of merchantability, fitness for purpose, or non-infringement. The Company reserves the right to withdraw or modify any aspects of the service at its absolute discretion. The Company does not warrant your use of the service will be secure or private; that use will be always available and uninterrupted, error free or that it will meet your requirements. We are unable to verify that material (including attachments) sent through the service will be virus free or that it will not have been intercepted and/or amended, and the Company deny liability for any loss or damage so caused.
Membership
Membership is obtained by registering personal details as required, and is available to individuals at least 18 years of age.
Standard membership is granted upon provision of relevant personal information and enables standard members to:-
o Browse the service
o Record their name and personal details against schools and/or colleges they attend(ed)
o Receive email messages via the address provided by them, sent by full members
o Opt whether to receive emails notifying new pupils registered at your school (such option is capable of being selected or deselected at any time)
Full membership is available subject to payment of a nominal annual charge, and in addition to the above, enables full members to:-
o Send emails to both standard and full members. Any member can use the 'Tell a friend' service to let their friends, relatives etc know about this site. We offer prizes each calendar month at our discretion to the member who has most friends registering with us for the first time, as recorded by our monitoring system, and subject to at least 4 new 'sign-ups' per calendar month.
o Record messages on any message boards provided by the Service
o Post and access photographs
o Enter reunion information for their schools or colleges
We reserve the right to amend the subscription fee for Full Membership, the period it covers and/or the services available. Fees paid will not be rebated or refunded unless the service subscribed is withdrawn from that member other than in circumstances permitted under this Agreement.
Registration
Members undertake to register, using accurate and current personal information, recording details only against those schools or colleges they attended at the relevant times. As a reasonable step to establish that the email address provided by you during registration, is controlled by you, a verification email will be sent to you. The simple instructions contained within that email should be followed to allow you to fully utilise the service.
Members also warrant that they are fully entitled to use any credit card details provided to enable settlement of any subscription fees, and that there are sufficient funds available to cover charges due.
Privacy
The Company's Privacy Policy forms part of these Terms and Conditions. Due to the very nature of the service, information posted is accessible to internet users around the world.
Standards of Content
The Company cannot be held responsible for the behaviour of members, who undertake not to post or allow to be posted any material that is in breach of any law; could be held to be offensive, threatening, obscene, pornographic, false or misleading, or to use the service for any business or commercial purposes. Furthermore, members must not post any information designed to facilitate direct communication between members, available otherwise to full members, including telephone or fax numbers, residential or commercial addresses, URL's or email addresses, other than requested by the Company for registration purposes.
Members, by submitting material to the service, represent that they are fully entitled to do so; grant us a non-exclusive, royalty-free, non-determinable licence right to copy, modify, distribute, show in public and create derivative works from that material in any form, anywhere, and authorize us to adapt the relevant material in the course of doing so, and so waive your moral rights to object to any derogatory treatment, or to be identified as the author of the material in question.
All members are requested to alert the Company of any information or content breaching the above, by emailing us at in@universityyaar.com
Whist the company does not monitor all information posted to the service, we retain the right to withdraw or edit any material, which at our absolute discretion appears to contravene any aspect of the above.
The Company expressly reserves the right to terminate or suspend membership of and access to the service without explanation or notice.
Proprietorship
Ownership of all content of the Service including intellectual property and other moral rights, its websites, bulletins, communications, data, information and any other material appearing therein (the 'Content') whether identified as copyright or not, shall vest absolutely and beneficially in the Company. It is expressly prohibited for members or visitors to the service to copy, publish, download, amend, distribute, display or sell the Content or any part thereof.
Amendments to Terms and Conditions and fees
The Company reserves the right to make amendments to its Terms and Conditions from time to time. Such changes will be notified on the Home Page of the Service. Any changes in Terms and Conditions will be applicable to all members and visitors. If you do not wish to accept any terms or conditions of the service at any time, you should request the Company to remove your details from the service, and cease to use the service.
Additional Services
Universityyaar or any associated company may offer new or additional services through the service from time to time. Your use of those services may be subject to additional rules or terms and conditions which you must comply with. Such rules, terms and/or conditions will be notified to you via the service, and failure to comply will amount to a breach of this agreement.
Any third party sites linked to the service do not necessarily carry our endorsement, and we have no responsibility or liability for their content.
Other Matters
The Company will not be liable to you or any third party for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business, whether caused through negligence, breach of this Agreement , or otherwise. The Company will not be liable for any failure to perform its obligations under this Agreement caused by matters beyond its reasonable control
Without limiting the above, the aggregate liability of the Company under this agreement in any 12 month period will not exceed the greater of 5 Euros or any amount paid by you to us by way of Full Membership fee, regardless of the cause or form of action.
Nothing in this Agreement limits the Company's liability for death or personal injury resulting from our negligence, or any other liability which may not by law be excluded. Any statutory rights you may have as a consumer remain unaffected.
You agree to indemnify the Company against all liabilities, claims and expenses that may arise from any breach of this Agreement by you or through any machine on which you may access the Service.
We reserve the right to assign this agreement and to assign or subcontract any or all of our rights and obligations under this Agreement.
Law and Jurisdiction
This Agreement shall be governed by the Laws of England, and any disputes arising from the Agreement and/or use of the Service, subject to the non-exclusive jurisdiction of the High Court of Ireland. Any judicial decree or decision holding any term of condition of this Agreement invalid or unenforceable shall not impact on the validity or enforceability of any other terms or conditions.
